DMCA Policy - University Of Metaphysical Sciences
The University Of Metaphysical Sciences ("UMS") respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act ("DMCA"). This policy outlines the procedures for reporting alleged copyright infringement and for filing a counter-notification when material has been removed.
UMS will respond to notices of alleged infringement that comply with the DMCA and other applicable laws. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the UMS website or services, please notify our designated Copyright Agent as set forth below.
Filing a DMCA Infringement Notice
If you believe that content available on our site infringes upon your copyright, please send a written notice to our designated Copyright Agent that includes the following information, as required by the DMCA (17 U.S.C. § 512(c)(3)):
- Identification of the copyrighted work claimed to have been infringed: Provide a detailed description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material claimed to be infringing: Provide information sufficient to permit us to locate the material, including the specific URL(s) or other precise location(s) where the allegedly infringing material can be found on our site.
- Your contact information: Provide your name, address, telephone number, and email address.
- A statement that you have a good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated Copyright Agent. Your counter-notification must include the following information, as required by the DMCA (17 U.S.C. § 512(g)(3)):
- Identification of the material that has been removed or to which access has been disabled: Provide information sufficient to permit us to locate the material and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Your name, address, and telephone number.
- A statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which UMS may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature: Your physical or electronic signature.
